Terms and Conditions of Business

Moto Ridescape is the organizer of the tours. The address is Antuna Vramca 7, Varazdin, Croatia. Please read our Terms and Conditions carefully, as by signing the reservation form, you accept our general business terms.

The reservation form is signed by Moto Ridescape (as the organizer of the tour) and you (as the participant). For a valid reservation, the reservation form must be signed and submitted along with proof of the deposit payment to our email at [email protected]. At the time of reservation, a non-refundable deposit is required to secure your spot on the trip in the amount of 25% of the total cost per person. Reservations are made on a first-come, first-served basis, and the number of spots on each tour is limited. The full payment (balance) is due 60 days before the start of the tour. If the amount is not received 60 days before the trip, Moto Ridescape reserves the right to cancel the reservation and retain the deposit.


Every tour you take with Moto Ridescape grants you a discount of 50 EUR per person on all future Moto Ridescape tours (e.g., second tour: 50 EUR discount, third tour: 100 EUR discount, fourth tour: 150 EUR discount, etc.), but no more than 300 EUR per person. This discount applies to drivers and passengers participating in all guided and self-guided tours with a minimum duration of nine days. For two tours of at least nine days in one season, Moto Ridescape offers a 100 EUR per person discount on the second tour.

Before the trip begins, each participant is required to sign a waiver statement. Otherwise, Moto Ridescape has the right to cancel the tour for that participant. Moto Ridescape is responsible for providing services as described in the trip itineraries according to local standards. However, due to situations beyond its control (such as hotel closures, roadworks, insufficient riding skills of the customer, weather conditions, natural disasters, etc.), Moto Ridescape reserves the right to cancel any part or the entire tour or make necessary changes without prior notice, with any additional costs, if applicable, to be paid by the customer.

Participants in motorcycle rental and/or motorcycle tours are fully aware of the risks and dangers involved and accept full responsibility. It is agreed and understood that the owners, operators and agents of this tour, including Moto Ridescape, are not guarantors of the participant’s safety and cannot be held responsible in any way for any incident related to any activity on the tour that may result in injury, death, or other damage to the participant, their property, their family, or heirs. 

Moto Ridescape is not responsible for any damage caused to third parties due to the participant’s activities during the trip.


Moto Ridescape is not responsible for any delays, schedule changes, or other conditions. Moto Ridescape is not responsible for delays caused by the manufacturer failing to deliver motorcycles on time. Moto Ridescape is not responsible for lost or stolen items from our rental locations or support vehicles. It is recommended that personal valuables and documents are not stored in the vehicle’s trunk.

Moto Ridescape agents and representatives represent us but are not parties to this contract, nor are they in any way responsible for any failure to provide any service as described in our literature related to the contract. 


If the participant does not adhere to traffic laws, Moto Ridescape reserves the right to cancel this contract and remove the participant’s rented motorcycle. The participant is responsible for all traffic fines received during the tour. A service charge will be applied for any unpaid fines. Participants agree that their actions during the motorcycle ride will not cause any damage to the natural environment or third parties.
If the participant repeatedly disregards the rules or causes others to feel endangered, Moto Ridescape reserves the right to revoke this contract and remove the participant’s rented motorcycle. To participate in the tour, each driver must have a valid motorcycle license. The participant is responsible for adhering to passport and visa regulations and assumes responsibility for any consequences arising from non-compliance.

The tour price includes accommodation in double rooms (double/twin rooms). If the participant is traveling alone but wishes to share a double room, Moto Ridescape will attempt to find a roommate in the same situation. If Moto Ridescape cannot find a roommate, a single room supplement will apply. A limited number of single rooms are available for an additional fee on a first-come, first-served basis, but availability
cannot be guaranteed. The tour price does not include anything not listed as included and all personal items. In the event of an activity potentially proposed as an additional activity for the tour, the participant is fully aware of the risks and dangers and accepts full responsibility.


Photographs and videos taken during the tours by Moto Ridescape representatives are copyrighted by Moto Ridescape. Moto Ridescape may use such material for advertising and marketing purposes, including images that may identify participants, without any compensation to the participants. Participants who send photographs to Moto Ridescape agree to allow Moto Ridescape to use such photographs for advertising and marketing purposes. 


The prices listed by Moto Ridescape, its agents, or publications are those in effect at the time of printing. In rare cases, due to situations beyond our control (such as inflation, etc.), Moto Ridescape reserves the right to change travel prices at any time before 60 days prior to departure. Motoridescape reserves the right to correct printing and calculation errors at any time. Discounts offered by Moto Ridescape cannot be combined with other existing discounts.

Moto Ridescape recommends that guests purchase appropriate travel, health, and accident insurance, as well as travel cancellation insurance. Moto Ridescape does not take responsibility for loss, damage, or delay in the delivery of luggage to participants. Luggage handed over to Moto Ridescape for transportation each day is at the participant’s own risk. Luggage insurance is recommended.

 

Moto Ridescape tries to organize travel dates during times when weather conditions are favorable for motorcycle riding. Moto Ridescape is not responsible for unfavorable weather conditions and no refunds will be issued for such conditions.

 

Tours operate on a seasonal basis, and if seasonal variations and/or weather conditions cause changes in the travel route or accommodation, the itinerary will be adjusted accordingly, and alternative hotels, restaurants, and roads will be used.

Motorcycles

All our motorcycles are insured with liability insurance for third parties and comprehensive vehicle insurance. The rental period is not interrupted due to damage to the motorcycle or the inability of the participant to operate the motorcycle. During the rental period, Moto Ridescape is not obliged to replace a damaged motorcycle.

 

Moto Ridescape offers comprehensive insurance with a security deposit (deductible) between €1,000 and €1,500, which must be paid to Moto Ridescape at the beginning of the rental period. The deposit will be retained until the undamaged motorcycle is returned in acceptable condition, at which point it will be refunded. 

Images of the motorcycles in the literature or on this website do not always represent the exact version of the offered motorcycles. Please send an email or call if you need specific information or details about the exact versions of the motorcycles. 

 

Moto Ridescape reserves the right to replace the confirmed motorcycle for the participant (due to uncontrollable situations such as mechanical issues, theft, etc.), but will try to ensure the reserved model. If this is not possible, Moto Ridescape will attempt to contact the participant before making any changes.

 

The rental terms are an integral part of the contract between Moto Ridescape and the renter, governing the use of the motorcycle. Rights to deviations, variations, or additional terms apply only in writing.

 

In the case of motorcycle rental without a guided tour reservation, a non-refundable deposit is required at the time of booking. The deposit secures your motorcycle rental. It amounts to 20% of the expected rental cost or at least €100. After receiving the deposit, your booking becomes final. If the participant does not send the deposit for the reservation, Moto Ridescape may cancel the reservation at any time. The remaining rental fee must be paid at least 45 days before the rental period begins. If the cancellation is received 45-15 days before the rental period begins, 50% of the full rental amount will be refunded. Cancellations received 15 days or fewer before the rental period will receive no refund. Changes to an existing rental reservation can be made for free once if requested at least 20 days before the rental period. Otherwise, a surcharge may apply.

The renter will receive the motorcycle with a full fuel tank and is obliged to return the motorcycle with a full tank. If the renter does not return the motorcycle with a full tank, a fuel refueling fee will be charged.


The renter is obliged to use the motorcycle with due care, adhere to appropriate technical codes of practice and handling instructions, and ensure road safety. The renter is obliged to comply with legal conditions, especially traffic regulations. The renter is responsible for paying all administrative fees, fines, and similar sanctions imposed on their use of the motorcycle, and any unpaid fines will be charged with an additional service fee. The renter is obliged to return the motorcycle in technically correct and roadworthy condition. The renter will also receive the vehicle documentation and tools.


The renter acknowledges and accepts any damage only if it is defined in writing on the damage form during the handover procedure. If repairs are necessary during the rental period to ensure the motorcycle operates or remains roadworthy, the renter must obtain consent from the lessor before proceeding with repairs. Further claims, regardless of legal grounds, are excluded unless the damage or loss is attributed to the renter’s intent or gross negligence.

The renter is prohibited from:

      • Allowing any other person to use the motorcycle except authorized individuals listed in the rental agreement.
      • Allowing authorized individuals to operate the motorcycle if they have been banned from driving or do not have a valid driver’s license or are unfit to drive.
      • Operating the motorcycle if banned from driving or lacking a valid driver’s license.
      • Using the motorcycle in an unsafe condition.
      • Using the motorcycle for commercial purposes.
      • Participating in any type of motorcycle racing, including training related to such events or track days.
      • Using the motorcycle off-road.
      • Pledging or selling the motorcycle or disposing of it or its parts, equipment, accessories, and documents in any way that could harm the lessor’s ownership rights or any other rights the lessor holds over the motorcycle.

In the event of damage or loss, as well as in the event of an accident, the renter must immediately notify Moto Ridescape. Tow and/or repair services may only be called after obtaining consent from Moto Ridescape. In the case of an accident, the police must be notified immediately. The renter must secure evidence (witnesses, traces, etc.), record the personal details of those involved, and do everything possible to contribute to the correct and complete clarification of the sequence of events.

 

The renter agrees to take financial responsibility up to the selected insurance option in case of damage to the motorcycle. Despite full comprehensive liability insurance, the renter remains responsible for damage in the following cases:

      • Any damage to the motorcycle caused by the renter or any other driver under the influence of alcohol, drugs, or any other substances impairing driving ability.
      • Any damage if the driver did not have a valid driver’s license at the time the damage occurred.
      • Any damage if the driver fled the accident scene.
      • Any damage caused by an unauthorized driver.
      • Lost or damaged GPS device (if rented with the motorcycle).
      • Failure to comply with the terms of the rental agreement.
      • Leaving the accident scene the renter was involved in.
      • Intentional, willful, or grossly negligent damage.
      • Exceeding the agreed rental period contrary to the terms of the agreement.
      • Lost motorcycle documentation: €80.
      • Lost motorcycle keys: €200.

The motorcycle must be returned without visible external defects. The renter must return the motorcycle in the same condition at the end of the rental period to the agreed location and time, with all vehicle documents, tools, and accessories. In the case of severe damage to the motorcycle that makes it unsuitable for riding or in the case of multiple damages on multiple sides of the vehicle within the same tour or rental, and if the insurance refuses to cover the costs, the renter is fully responsible for the repair costs, return and transport costs, expert costs, and any depreciation in technical and market value. “Damage” excludes reasonable wear and tear. Damage caused by scratches from an accident, dropping the motorcycle, or driving the motorcycle through bushes or off-road is not considered normal wear and tear.

The lessor has the right to terminate the rental agreement without prior notice if there is a compelling reason that makes the continuation of the rental agreement unacceptable. Important reasons include particularly inaccurate personal details of the renter, credit data, and serious violations of the terms of the rental agreement. In the case of withdrawal without prior notice, the rented motorcycle must be returned immediately, i.e., before the expiration of the agreed rental period. The lessor’s right to claim damages and compensation remains unchanged.


The renter agrees to take financial responsibility for all traffic violations committed on the rented motorcycle during the rental period.


Moto Ridescape offers a support van for luggage and up to two passengers as part of the travel package for guided tours. The calculation is made based on the number of participants who wish to have such support. 


The renter ensures that:

      • The water in the radiator and battery of the motorcycle is maintained at the proper level.
      • The oil in the motorcycle is maintained at the proper level.
      • The tire pressure is maintained at the proper level. 

The renter is obliged to ensure that when handling and parking the motorcycle, all reasonable care is taken, and the motorcycle is securely locked when not in use, including locking the handlebars and activating the alarm if the motorcycle is equipped with one.

Own motorcycle

A participant on a Moto Ridescape tour with their own motorcycle is responsible for ensuring that the condition of the motorcycle complies with the law and is in flawless technical condition. The buyer is obliged to reimburse Moto Ridescape for any damages that may arise due to non-compliance with this provision. The buyer bears any additional costs (e.g., for returning the vehicle, fixing technical deficiencies, etc.). In the event of damage or failure of the motorcycle during the tour, Moto Ridescape is not responsible for actions related to the event nor obliged to change the impact on the tour’s plan, route, or pace. Participation with one’s own motorcycle on a tour is possible upon request, provided there are available spots for personal motorcycles not part of the tour package. Separate rentals with other companies or separate rentals in relation to the travel package are not possible. Moto Ridescape does not offer vehicle insurance for customers participating in the tour with their own motorcycle.

Tour Cancellation

Cancellations received 60 (or more) days before departure are subject to a cancellation fee of the ‘Reservation Deposit’. 

For cancellations received less than 60 days before departure, the cancellation fee (per person) is as follows: 59-40 days = 40% of the tour price; 39-25 days = 75% of the tour price; within 24 days = 100% of the tour price. 

Travel cancellation insurance is highly recommended. No exceptions to this policy are made for any reason.


Up to 14 days before the tour start date, Moto Ridescape can cancel the tour if the minimum number of customers for the tour is not met. In such a case, the guest will be notified as soon as possible, and Moto Ridescape will offer an alternative tour if all participants agree to a surcharge due to the small number of tour members. If the participants do not agree to pay the surcharge, Moto Ridescape will refund their deposit and payments in full, which constitutes full settlement.

Moto Ridescape is not responsible for any additional costs or losses incurred by the participant (e.g., prepaid flight tickets, hotel reservations, etc.) due to tour cancellation due to a lack of participants. 


There may be situations beyond our control that will require us to change or cancel a trip, change the itinerary, or make substitutions related to hotels, cities, guides, and other travel arrangements. We do not assume responsibility for any resulting losses, costs, or inconveniences to the participant. Moto Ridescape is not obliged to refund money after the tour has started, regardless of the reason for the participant’s inability to complete the tour.


Motoridescape is not responsible if the participant is denied entry to certain countries or is delayed or detained by customs and immigration authorities or local police. This applies to participants who do not meet the official entry requirements (e.g., passport, visa, etc.).

Instructions on how to submit complaints:
We inform our valued service users that complaints can be submitted via email at [email protected]. A response to the received complaint will be provided within 15 days of receipt.

Procedure related to complaints:
Through email, the traveler complains about unsatisfactory services to the tour guide or representative of the organizer, and if there is none, to the service provider. If the traveler does not submit a complaint in the manner described above but consumes
the service, they waive the right to compensation. The traveler is obliged to cooperate with the tour guide or the representative of the organizer and the service provider to resolve the issue. If the traveler does not accept the offered solution that matches the paid service, the organizer will not apply any subsequent complaint or response from the traveler.

      • If the cause of the complaint is not resolved, the traveler and the tour guide or the representative of the organizer or service provider will prepare a written confirmation in two copies, both of which will be signed. The traveler will keep one copy of this confirmation.
      • No later than 8 days after returning, the traveler must submit the written complaint at the sales point where the arrangement was paid for, attaching the written confirmation signed by the representative and possible receipts for additional costs. The organizer will only process fully documented complaints received within the 8-day period.
      • The organizer is obliged to issue a written decision on this contract within 14 days of receiving the complaint at the sales point. The organizer can extend the deadline for resolving the complaint by gathering information and verifying the complaint’s claims with the service provider for up to another 14 days. The organizer will resolve only those complaints whose cause could not be resolved at the place of stay. Until the organizer decides on the traveler’s complaint, the traveler waives any mediation by other persons, judicial institutions, or the provision of information in the media.
